1. Introduction & Acceptance
By accessing or using the NeuMind platform (the "Platform", the "App", "we", "us"), you ("User", "you") agree to these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform.
These Terms govern the use of NeuMind's website, mobile applications, and related services that enable Users to interact with campus canteens and food vendors.
2. Definitions
User: Any student, customer, or individual accessing the Platform.
Vendor / Canteen Owner: An independent food business using the Platform to display menus and accept orders.
Order: A request placed by a User to purchase items from a Vendor.
Pre-Order: An order scheduled for a future time slot as configured by the Vendor.
Guest / Custom Order: An order placed without linking a registered Student ID, as supported by the Platform.
3. Role of NeuMind — Marketplace Intermediary
NeuMind is a government-registered technology platform. We do not own, prepare, package, or deliver food.
Each Vendor is an independent business solely responsible for:
- Menu content and pricing
- Food preparation and safety
- Packing and hygiene
- Delivery operations
NeuMind's function is limited to enabling order placement, communication, and payment processing.
4. Eligibility & User Responsibilities
To use the Platform, you must:
- Be at least 18 years old (or have valid parental/guardian consent when applicable).
- Provide accurate and complete registration details.
- Maintain the confidentiality of your login credentials.
- Use the Platform only for lawful and permitted purposes.
You are responsible for all activity conducted through your account.
5. Vendor Obligations
Vendors are required to:
- Hold and maintain all legally mandated licenses (GST, FSSAI, PAN, and any local permits).
- Ensure compliance with food safety and hygiene standards.
- Manage fulfilment, delivery, and customer service independently.
- Provide accurate business information, which NeuMind may display as received.
NeuMind does not verify Vendor certifications or operational practices.
6. Orders, Pricing & Payments
- All orders constitute a direct transaction between the User and the Vendor.
- Vendors control their own pricing, menus, and availability.
- Payments are processed through authorised PhonePe gateway.
- NeuMind does not store card, UPI, or banking credentials.
- Taxes (including GST under MAHIMA ENTERPRISES) are displayed as provided by the Vendor and/or required by law.
7. Delivery & Pickup
Delivery is managed entirely by the Vendor. NeuMind does not operate any delivery fleet.
- Vendors may offer delivery, pickup, or in-canteen collection based on their capabilities.
- Delivery estimates—such as the target "under 45 minutes"—are indicative only and not guaranteed.
- Actual delivery times may vary based on Vendor workload, campus conditions, or external factors.
- Users must contact the Vendor directly for delivery-related concerns, delays, or status enquiries.
NeuMind is not liable for delivery delays or logistics-related issues.
8. Pre-Order Feature (Scheduled Orders)
NeuMind supports Vendor-configured pre-ordering. The following apply:
- Availability: Vendors define the time slots, windows, and pre-order schedules.
- Lead Time / Cut-offs: Vendors determine how early a pre-order must be placed and when modifications cease.
- Modifications & Cancellations: Subject entirely to the Vendor's own rules and timing.
- Payment: Pre-orders typically require full payment at checkout.
- Fulfilment: Vendors are solely responsible for preparing pre-orders on time.
- Disputes: Any refund or adjustment for pre-orders must be resolved with the Vendor.
NeuMind displays Vendor-provided rules clearly at checkout but is not responsible for enforcement.
9. Cancellations & Refunds — NeuMind's Strict Policy
NeuMind follows a strict no-cancellation, no-refund policy.
- Once an order is placed and confirmed by a Vendor, it cannot be cancelled through NeuMind.
- NeuMind does not issue refunds, credits, replacements, or compensations.
- Delays, change of mind, or dissatisfaction do not qualify for refunds from NeuMind.
- In rare cases, a Vendor may offer a refund at their sole discretion. Such matters must be handled directly with the Vendor.
- NeuMind does not guarantee any outcome of Vendor-initiated disputes.
For pre-orders, any cancellation or refund depends entirely on Vendor policy.
10. Intellectual Property
All intellectual property on the Platform—including logos, trademarks, software, visuals, and written content—is owned or licensed by NeuMind. Users may not copy, modify, distribute, or create derivative works without written permission.
11. User Content & Reviews
Users may submit ratings or reviews. By submitting content, you confirm that:
- You own or have rights to the content;
- It is accurate and does not violate third-party rights.
NeuMind may moderate or remove content at its discretion and is not responsible for User-generated content.
12. Disclaimers & Limitations of Liability
- The Platform is provided on an "as is" and "as available" basis.
- NeuMind disclaims all warranties relating to Vendor products, delivery, and services.
- NeuMind is not liable for indirect, incidental, or consequential damages, including but not limited to:
- Loss of data
- Loss of profits
- Food-related health issues
- Delivery delays or failures
To the extent permitted by law, NeuMind's liability is strictly limited.
13. Indemnification
You agree to indemnify and hold NeuMind, its directors, employees, and partners harmless against any claims arising from:
- Violation of these Terms
- Misuse of the Platform
- Breach of applicable laws
- Actions related to your interactions with Vendors
14. Suspension & Termination
NeuMind may suspend or terminate your access to the Platform, with or without notice, for reasons including but not limited to:
- Violating these Terms
- Fraudulent activity
- Misuse or abuse of services
Users remain responsible for all obligations (including outstanding orders) prior to termination.
15. Privacy & Data Handling
Use of the Platform is governed by our Privacy Policy.
By using the Platform, you consent to NeuMind's collection, processing, and sharing of data necessary for order fulfilment, including sharing name, order details, and contact information with Vendors.
16. Changes to These Terms
NeuMind may update these Terms periodically.
The "Last Updated" date will reflect the latest revision. Continued use of the Platform indicates acceptance of the updated Terms.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of India.
Any disputes will fall under the exclusive jurisdiction of the courts in Kota, Rajasthan, unless required otherwise by mandatory law.
18. Consumer Rights
Nothing in these Terms restricts rights granted to Users under applicable consumer protection laws.
